1- Work permit Requirements

  • Convincing the immigration officer that you will leave Canada upon expiration of work permit
  • A job offer from an eligible Canadian employer
  • Not be inadmissible to Canada
  • Proof of funds to support yourself and your family during your stay in Canada

2-Types of Work permit

2-1- Needing a Labour Market Impact Assessment (LMIA):

  • Temporary Foreign Worker Program (TFWP)
    • Where Canadian employers hire a foreign national temporarily
    • The employer can only hire the foreign national after proving that they could not find a Canadian citizen or permanent resident to fill the position
      • A positive LMIA demonstrates a Canadian citizen or permanent resident was not found for the position
      • A negative LMIA demonstrates that the position needs to be filled with a Canadian citizen or permanent resident
    • Global Talent Stream (GTS)
      • For Canadian employers to hire highly skilled foreign workers to compete on an international scale

2-2- Open Work permit – No job offer or LMIA necessary

  • PGWP: work permit upon graduating from a post-secondary DLI
  • Spousal Sponsorship (inside Canada)
  • Spouse Accompanying International Student/Worker
  • Bridging Open Work Permit (BOWP): authorizes foreign nationals to work while waiting for a decision to be made on their permanent residency application
  • International Experience Canada (IEC): Enables foreign nationals that are participating in an IEC program outside of Canada

2-3- LMIA-exempt –Requires job offer only

  • International Mobility Program: allows employers to hire foreign national without the need of an LMIA; this exemption is granted on the basis that the position the foreign foreign national will occupy…
    • Brings a broader competitive advantage for Canada
    • Benefits Canadian Citizens and Permanent Residents
  • Significant Benefit (C11): The foreign applicant must demonstrate significant benefit to Canada. This could be either socially or culturally.
  • NAFTA work permits: foreign nationals associated with NAFTA may be eligible to work in Canada
  • CETA work permits: Provides the opportunity for EU citizens to work in Canada
  • Intra-Company work permits: When a foreign national is an employee of a multinational company, they may be eligible to work in Canada if the company has a location in Canada as well.
